Welcome to www.paradiseglades.com (the “Website”), operated by Ron and Luella Miller (“we,” “us,” or “our”). This Website provides information about and facilitates inquiries and bookings for our ski condo located in Paradise Ridge at Mt. Washington Alpine Resort, British Columbia, Canada.
By accessing or using this Website, including submitting an inquiry or booking request, you (“you” or the “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Website.
We may update these Terms from time to time. Continued use of the Website after changes constitutes acceptance of the revised Terms. We will post the new “Last Updated” date.
1. Website Purpose and Services
The Website offers information about our vacation rental property (the “Property”), photos, availability calendars, rates, and an inquiry/booking request form. It does not constitute a binding rental contract. Any reservation is subject to confirmation, availability, and execution of a separate Rental Agreement. Actual bookings are finalized via email, phone, or other direct communication, and require acceptance of our full Rental Agreement and these Terms.
2. Provincial Registration
This rental complies with British Columbia’s short-term rental requirements. Our provincial short-term rental registration number is H446820970. We also comply with applicable Comox Valley Regional District and Mt. Washington Resort/strata rules.
3. User Eligibility
You must be at least 19 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. The primary guest for any booking must be 25 years or older. We reserve the right to refuse any inquiry or booking at our sole discretion.
4. Reservations, Payments, and Rates
• A 50% deposit is required at the time of booking confirmation. The balance is due 30 days before arrival.
• We accept e-transfer and Bitcoin. All rates are quoted in Canadian Dollars (CAD) and exclude applicable taxes (GST/PST) and the cleaning fee.
• Minimum stay: 2 nights (3 nights during Christmas, New Year’s, and spring break periods).
• Rates and availability are subject to change without notice until a booking is confirmed in writing.
• All bookings are subject to our separate Rental Agreement, which guests must accept prior to final confirmation.
5. Check-In and Check-Out
• Check-in: 4:00 PM
• Check-out: 11:00 AM
Late check-out may incur a fee of $150.
Self check-in is via lockbox or smart lock. Detailed instructions will be emailed approximately 48 hours prior to arrival.
6. Maximum Occupancy and Guests
Maximum occupancy is 6 guests (including children). Only guests listed on the reservation may stay overnight. Additional day guests require prior written approval and may incur a $50 per person per day fee.
We do not rent to parties or large groups. This is a family-friendly condo.
7. House Rules
By booking, you and all guests agree to abide by the following rules (full details in the Rental Agreement):
• Smoking/Vaping: No smoking or vaping (including cannabis) anywhere in the unit or on balconies/patios. Violation incurs a $500 deep-cleaning fee. Strata rules prohibit smoking anywhere on the property.
• Pets: No pets allowed (per strata bylaw in Paradise Ridge). Service animals are welcome with prior notice and documentation.
• Quiet Hours: 10:00 PM – 8:00 AM. Loud music, parties, or excessive noise are prohibited and may result in immediate eviction and fees.
• No Parties or Events: This includes bachelor/bachelorette parties or gatherings beyond registered guests.
• Ski Storage: Use the provided ski storage locker for skis/boards. Do not store wet gear inside the unit.
• Shared Amenities (pool, hot tub, sauna): Access is included during ski and summer seasons, subject to strata hours and possible maintenance. Use is at your own risk (no lifeguard). Hot tub towels must be cleaned and dried before departure.
• General Conduct: Respect neighbors and strata rules at all times.
8. Cleaning and Housekeeping
A professional cleaning fee of $175 is charged per stay. Guests must leave the Property in reasonable “broom-clean” condition: dishes washed, trash/recycling removed to designated bins, appliances wiped, and linens/towels placed in the laundry area (start a load of towels if possible). Excessive dirt, trash removal, or prohibited items (e.g., pet hair) may result in additional fees of $150 or more.
9. Damage, Security Deposit, and Liability
You are financially responsible for any damage beyond normal wear and tear, missing items, or excessive cleaning. We will provide an itemized invoice. Report any pre-existing damage or issues within 24 hours of arrival.
We are not liable for personal injury, loss of belongings, or incidents related to use of the Property, shared amenities, or resort activities (including skiing, snow conditions, pool/hot tub use, weather, power outages, or road access). All use is at your own risk. Guests assume all risks associated with mountain resort activities and winter conditions.
10. Parking and Access
One assigned parking spot is provided in the lower parkade. Limited overflow parking is available (first-come, first-served) in the upper parkade or outdoors. No oversized vehicles, trailers, or RVs without prior approval.
11. Ski Season and Weather
• Snow removal for common areas is handled by the strata/resort. You are responsible for clearing your vehicle and immediate walkway as needed.
• Heat must be maintained at a minimum of 10°C (50°F) during winter to prevent pipe freezing. You are responsible for any freeze-related damage.
• We are not responsible for disruptions caused by power outages, extreme weather, poor snow conditions, or resort closures (these are acts of nature).
12. Cancellation Policy
• More than 60 days before arrival: Full refund minus a 5% processing fee.
• 30–60 days before arrival: 50% refund.
• Less than 30 days before arrival: No refund (unless the Property is re-rented, in which case we will refund the difference).
No refunds or credits will be issued for resort closures, limited operations, poor snow conditions, or weather-related issues.
13. Intellectual Property
All content on this Website (text, photos, logos, etc.) is our property or licensed to us. You may not copy, reproduce, or use any content without our prior written permission.
14. Privacy
Your use of the Website is also governed by our Privacy Policy, which is incorporated by reference. We collect information (such as name, email, and booking details) to process inquiries and reservations.
15. Disclaimers and Limitation of Liability
The Website and Property information are provided “as is.” We do not guarantee the accuracy, completeness, or availability of any content, including photos, descriptions, or resort information (which can change).
To the fullest extent permitted by law, we disclaim all liability for any damages arising from use of the Website or the Property, including indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for your booking (if any).
16. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada. Any disputes shall be resolved exclusively in the courts of British Columbia.
17. Miscellaneous
• These Terms, together with the Rental Agreement and Privacy Policy, constitute the entire agreement.
• If any provision is found invalid, the remaining provisions remain in effect.
• Our failure to enforce any right does not constitute a waiver.
• We reserve the right to refuse service or cancel any booking for violations of these Terms or house rules.
